COPYRIGHT:

LILY PHOTOGRAPHY LLC retains the exclusive copyright protection for all images taken during the Photography Session. The CLIENT shall only use the prints, including digital files, in accordance with the permissions within this agreement. The Client’s prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. LILY PHOTOGRAPHY LLC grants the CLIENT permission to share the purchased images with family, friends, and on social networking websites, marketing material, websites etc. so long as the images remain unaltered and textual credit as provided by the Photographer.

USAGE: LILY PHOTOGRAPHY LLC reserves the right to use the negatives and/or reproductions for display, publication, marketing or other purposes. Originals remain the property of the photographer.

OFFICIAL BOOKING:

A non-refundable Initial deposit (as discussed) is due at the time of booking your session and this contract is signed & returned to the photographer as well. This guarantees the time and date allotted for you. Should payment and contract not be returned, LILY PHOTOGRAPHY LLC reserves the right to offer the date and time to another client.

MODEL RELEASE: CLIENT grants permission to LILY PHOTOGRAPHY LLC and its assigns, licensees, and sub-licenses, permission to use CLIENT’S image or likeness in any and all forms of social media.  Therefore, LILY PHOTOGRAPHY LLC may use CLIENT’S likeness and image on PHOTOGRAPHER’S website or other advertising for LILY PHOTOGRAPHY LLC.

PAYMENT:

Full payment amount AS DISCUSSED is due at or before the session (minus deposit). The amount agreed upon covers the photographer’s time, talent, proofing and editing. It also cannot be changed or altered by any means.

LILY PHOTOGRAPHY LLC'S price list is adjusted periodically and future orders will be charged at current pricing of that time.

RELEASE OF DIGITAL FILES: Photographer will release the high resolution files (digital negatives) from the wedding via digital download. By releasing the digital negatives, Photographer authorizes the Client to use the images contained in the download for their own personal use, including printing of the images at a lab of Client’s choosing.

DUTY OF CLIENT: CLIENT will obtain all permissions necessary for LILY PHOTOGRAPHY LLC to photograph at the session. LILY PHOTOGRAPHY LLC has no duty to obtain permission of reception centers, churches, buildings, properties, or other locations to operate thereon. CLIENT understands and agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of photographer.



RELEASE FROM LIABILITY: LILY PHOTOGRAPHY LLC shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.

CANCELLATION: In case of a cancellation at the clients request, the initial payment of $50.00 is nonrefundable.

In the event that the CLIENT requests to reschedule a session, the retainer shall be applied to a rescheduled session. Reschedule must be within the same calendar year.

Should the CLIENT need to reschedule for any reason besides weather with less than 72hr notice (discussed with LILY PHOTOGRAPHY LLC) a $50 charge will be applied to total remaining balance.

Any CLIENT that is late arriving to the session will have the amount of time late deducted from the time allotted for the session.

INDEMNIFICATION: LILY PHOTOGRAPHY LLC and CLIENT agree that LILY PHOTOGRAPHY LLC is under no obligation to capture any specific moment or pose or person(s) during the photography session. 

If LILY PHOTOGRAPHY LLC is unable to perform the services in this contract due to any cause outside its control, client agrees to indemnify photographer for any loss, damage or liability; however, LILY PHOTOGRAPHY LLC will return in full all payments made by CLIENT in relation to this EVENT. 

CLIENT agrees to indemnify and hold harmless LILY PHOTOGRAPHY LLC for any liability, damage, or loss related to technological failure, including data loss. 

CLIENT understands and agrees that LILY PHOTOGRAPHY LLC is not required to maintain copies of the photos from this shoot 60 (sixty) days after the photos have been delivered to CLIENT.

PHOTOGRAPHER: LILY PHOTOGRAPHY LLC reserves the right to substitute with another

photographer. The substitute photographer is chosen at the discretion of the

Photographer and does not constitute a breach of this agreement. LILY PHOTOGRAPHY LLC warrants the substitute photographer to be of comparable quality and

professionalism.

ARBITRATION: Any dispute arising under or in any way related to this agreement shall be submitted to binding arbitration by the American Arbitration Association in accordance with the Association’s commercial rules than in effect. The arbitration shall be conducted in the state of Florida. The arbitration shall be binding on the parties.

FINAL PICTURES: LILY PHOTOGRAPHY LLC will choose the best images from your session. The images will be uploaded into an online gallery ready to be downloaded with a code within 4-5 weeks of event. A sneak peek of images will be delivered in 5-7 days. CLIENT will receive at least the minimum amount of images stated in your selected package.

Final images are individually edited at the full discretion of the Photographer. These images are used for online proofing, high resolution files and albums. Client cannot alter images in ANY way. Photographer will edit photos for color correction, exposure and basic retouches. Extensive editing at the request of the Client can be purchased at an additional fee.
